Terms of Service

1. Who we are & acceptance of these Terms

Snagify ("Snagify", "the Service", "we", "us") is a product operated by INNOVADATA ANALYSIS SERVICES - FZCO, a free zone company incorporated in the United Arab Emirates under Trade License No. 72335, issued by the Dubai Integrated Economic Zones Authority (IFZA), with its registered address at IFZA Properties, Dubai Silicon Oasis, Dubai, UAE ("the Company").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users, including property professionals, landlords, tenants, and any person who signs a document through the Service.

2. The Service

Snagify is a digital property inspection platform enabling users to document property conditions with photographs and notes, collect electronic signatures, and generate PDF inspection reports, designed for the UAE rental market.

Snagify provides documentation tools. Snagify does not provide legal advice, and does not act as a surveyor, valuer, or expert witness. Reports are designed to meet common documentation standards, but their acceptance or evidentiary weight in any dispute, court, rental committee, or administrative proceeding remains at the sole discretion of the relevant authority. Snagify makes no representation as to the outcome of any proceeding.

We may modify, add, or remove features of the Service. We will give reasonable notice of material changes that adversely affect paid features.

3. Eligibility & accounts

• You must be at least 18 years old and legally capable of entering into contracts.
• You must provide accurate, current information when creating your account and keep it updated.
• You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately at hello@snagify.net of any unauthorized access.
• One person or entity may not maintain multiple accounts to circumvent plan limits or credit allocations.
• Where an account is used by a company's team members, the account owner is responsible for its team's compliance with these Terms.

4. Electronic signatures

The Service enables inspection reports to be signed electronically (including signature pad and one-time-password verification). By signing a document through the Service, each signatory (whether or not they hold a Snagify account) consents to conduct that transaction electronically and agrees that their electronic signature has the same effect as a handwritten signature, to the extent permitted by UAE Federal Decree-Law No. 46 of 2021 on Electronic Transactions and Trust Services (or any successor legislation).

Each signatory is responsible for reviewing the report before signing. By signing, a signatory acknowledges the findings recorded in the report as of the date of signature.

You may not sign on behalf of another person without lawful authority, and you may not misrepresent your identity in any signature process.

5. AI-assisted content

The Service uses artificial intelligence to assist with documentation, including draft photo descriptions, suggested damage tags, suggested evolution assessments, and report summaries ("AI-Assisted Content").

• AI-Assisted Content is a draft aid only. It is presented for review and remains subject to validation, edition, or rejection by the inspecting user before a report is finalized and signed.
• The inspecting user is solely responsible for reviewing and confirming the accuracy of all content in a report before it is signed, including AI-Assisted Content they choose to keep.
• Snagify does not warrant that AI-Assisted Content is accurate, complete, or free of error, and accepts no liability for content that a user has reviewed, validated, or left uncorrected in a signed report.

6. Plans, credits & billing

Professional subscriptions. Professional plans are billed monthly or annually through our payment processor. Subscription credits are allocated on each billing cycle and roll over up to a plan-defined cap, as displayed on your plan page. Credits above the cap are forfeited. Annual plans are refundable only within the first 14 days of the initial purchase; monthly fees for the current billing period are non-refundable.

Credit packs. Credits purchased as one-time packs do not expire and remain on your account until used or the account is closed. Credit pack purchases are non-refundable once any credit from the pack has been used.

Individual accounts. Check-in inspections are free for individual accounts; credits are consumed for check-out inspections as indicated at the time of use.

Pricing changes. We may change plan pricing or credit allocations with at least 30 days' notice; changes apply from your next billing cycle.

Failed payments. If a subscription payment fails, access to paid features may be suspended until payment is resolved. Account data is retained for 90 days following suspension, after which we may close the account subject to Section 8.

7. Your content

You retain ownership of the inspection data, photographs, notes, and reports you create ("User Content"). You grant the Company a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, and display User Content solely to operate, provide, secure, and improve the Service, including generating reports and enabling verification.

You represent and warrant that: you have the lawful right to access and photograph the properties you inspect; your User Content is accurate to the best of your knowledge and does not infringe any third party's rights; you have obtained any consent required to photograph identifiable individuals, or have avoided capturing them.

8. Document integrity, retention & "Verified Document"

Integrity. Signed reports include a SHA-256 content hash and a verification link/QR code. The "Verified Document" indication and the verification page attest only that the presented document matches the record hashed and stored by Snagify. It is not a government, RERA, or judicial certification, and it is not a warranty of the accuracy of the report's content.

Retention of signed reports. Because signed reports serve as records for all signing parties (not only the account holder), signed reports, their verification hashes, and associated signatures are retained for five (5) years from the date of signature, including after the account that created them is closed. This retention preserves document verification for tenants, landlords, and other signatories.

Other data. Upon account closure, User Content other than signed reports (drafts, unsigned inspections, account data) is deleted within 30 days, except where retention is required by law.

9. Acceptable use

You may not use the Service to:

• create false, misleading, or fabricated inspection reports;
• backdate, alter, or misrepresent the timestamp, content, or signature of any inspection;
• impersonate any person, or sign without lawful authority;
• photograph identifiable individuals without consent where consent is required;
• access properties without lawful right;
• scrape, reverse-engineer, resell, or copy the platform or its outputs at scale;
• interfere with or circumvent security or access controls;
• use the Service for any purpose unlawful under UAE law.

Violations may result in immediate suspension or termination and, where appropriate or required, reporting to relevant authorities.

10. Relationships between users and third parties

Snagify is a documentation tool. Any relationship between an agency and its clients, a landlord and a tenant, or an inspector and any party (including any fees charged by a professional for inspection services) is exclusively between those parties. The Company is not a party to, and bears no responsibility for, such relationships, agreements, or disputes.

11. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, that data will never be lost (maintain your own copies of downloaded reports), or that any report will be accepted or given weight in any specific proceeding.

12. Limitation of liability

To the maximum extent permitted by applicable law: our total aggregate liability for all claims arising from or relating to the Service is limited to the amounts you paid us in the three (3) months preceding the event giving rise to the claim; we are not liable for indirect, incidental, special, or consequential damages, loss of profits, loss of data, lost security deposits, missed legal or procedural deadlines, the outcome of any dispute, rental committee, or court proceeding, or decisions made in reliance on reports or AI-Assisted Content generated through the Service.

Nothing in these Terms excludes liability that cannot be excluded under UAE law.

13. Indemnification

You agree to indemnify and hold harmless the Company, its officers, employees, and agents from any claim, demand, loss, or expense (including reasonable legal fees) arising from: (a) your User Content; (b) your breach of these Terms; (c) your violation of any law or third-party right, including rights of privacy or property access; or (d) any dispute between you and another user or third party relating to your use of the Service.

14. Termination

You may close your account at any time in your account settings. Fees for the current billing period are non-refundable. Sections 8, 11, 12, 13, 16, and 17 survive termination.

We may suspend or terminate your account with immediate effect if you materially breach these Terms, if required by law, or to protect the integrity of the Service. Where practicable, we will give notice and an opportunity to export your data.

15. Changes to these Terms

We may update these Terms. Material changes will be notified (email or in-app) at least 14 days before taking effect. Continued use after the effective date constitutes acceptance. The "Last updated" date reflects the current version.

16. General

• Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control.
• Severability. If any provision is held unenforceable, the remainder stays in effect.
• Entire agreement. These Terms, with the Privacy Policy, are the entire agreement between you and the Company regarding the Service.
• No waiver. Failure to enforce a provision is not a waiver of it.
• Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition, or sale of assets, with notice to you.

17. Governing law & jurisdiction

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. Any dispute arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.
